Del mismo modo, el instructor rechaza los argumentos de la defensa de los investigados sobre que la direcci\u00f3n de la c\u00e1tedra extraordinaria no ten\u00eda retribuci\u00f3n y que los fondos iban al patrimonio de la UCM. \u201cEl beneficio puede ser indirecto y a favor de un tercero\u201d, dice la resoluci\u00f3n.<\/p>\n<p>Peinado justifica , de forma surrealista, que \u201cpor mucho que se busque en la jurisprudencia, que analice o interprete este tipo penal (&#8230;) no podr\u00e1 hallarse un supuesto de similares caracter\u00edsticas, pues las conductas que provienen de palacios presidenciales, como este supuesto, parecen m\u00e1s propias de reg\u00edmenes absolutistas, por suerte, ya olvidados en el tiempo en nuestro Estado, lo que obliga a tratar de analizar (quiz\u00e1 hubiera que remontarse al reinado de Fernando VII) este tipo desde la perspectiva de una interpretaci\u00f3n teol\u00f3gica y hermen\u00e9utica\u201d.
